Chartered accountant David Anthony Warren and company director Noel Cunningham were to have gone on trial on Monday before magistrate Amrith Chabillal, in the Bellville Specialised Commercial Crime Court in Cape Town.
However, defence attorney William Booth told the court Cunningham was seriously ill, and that he would make written representations to the Western Cape Directorate for Public Prosecutions, on Cunningham's behalf, for the withdrawal of the charge.
Prosecutor Max Orban alleges Fidentia, represented by the company's then chief executive J Arthur Brown between 2005 and 2006, bought shares in the company Webworths for R160 million, when in fact Webworths was worth much less.
Orban alleges the transaction took place on the strength of alleged false financial statements prepared and audited by Warren. At the time Webworths was owned by the MI Cunningham Trust.
